Guardianship becomes necessary in the event a family member or loved one becomes incapacitated and is unable to make personal and/or financial decisions for themselves.

If that individual has not executed sufficiently broad advanced directives (such as a power of attorney or health care directive), the attorneys at Enea, Scanlan & Sirignano, LLP can commence a Guardianship proceeding, known in New York State as an Article 81 Proceeding, to have a family member, family advisor or friend appointed as Guardian and/or Guardian of the Property for the person to make health care, property or financial decisions.
